How the Death of a Parent Effects Child Support

The Social Security Administration pays a custodial parent can get up to 75% of the deceased parent’s Social Security benefit. This is factored on the amount of Social Security that the deceased parent has paid in for their Social Security benefits upon retirement. This is not to be confused with spousal benefits which are awarded regardless if a person is currently married or divorced and only payable if the two spouses were married for 10 years total, meaning if you divorced after 2 years and later remarried and stayed married for 8, that is a total of 10.
